1. Parties, scope and status
These proposed terms govern use of Harapan Kita’s website and web app for community and case services provided by the responsible DAP service-centre organisation. The responsible service centre and postal address are identified above; its authority to enter the agreement still needs to be documented. Tootaio Studio is the developer and temporary data custodian, not automatically the party responsible for deciding a case or granting assistance. This version is a review draft with no effective date. Publication of a link does not by itself prove that a user accepted an agreement or gave every data-processing consent.
2. Eligibility and authority
You must be at least 18 and capable of entering the relevant arrangement. If acting for another person, household or organisation, you must have authority and provide accurate information about that role. Staff access requires individual authorisation and is limited by assigned permissions and intake responsibilities. Do not impersonate a resident, staff member or public agency, borrow another person’s identity or claim authority you do not have. The platform is not an official SPR electoral registration, government complaint portal or proof of DAP membership. Its polls are community feedback, not statutory elections.
3. Nature and limits of services
The platform supports complaints, consultations, case follow-up, resident records, welfare administration, published information, community participation and authorised staff work. Availability depends on the selected intake point, service area, enabled features, staffing and connectivity. Submitting a request does not guarantee acceptance, legal representation, eligibility for benefits, funding, a particular outcome or a response time unless expressly confirmed for that service. A referral does not transfer a government body’s legal powers to the platform. Use the appropriate emergency services for imminent danger; the platform is not continuously monitored as an emergency channel.
4. Accounts, identity and devices
Provide accurate information and keep your device, staff password, session and complaint-access details secure. Resident profile convenience and IC/phone matching must not be assumed to provide the same security as verified government identity or one-time-password authentication. Do not use another person’s identifiers to retrieve records. Sign out and clear remembered details on shared devices; a resident sign-out removes local remembered identity but does not delete server records. Report suspected access immediately. Staff must use personal accounts, avoid sharing credentials, respect session controls and protect exports and printouts.
5. Submissions and referrals
Submit information you reasonably believe is accurate and distinguish facts, allegations and opinion. Provide only relevant documents that you have authority to share; redact unrelated people’s details where possible. You remain responsible for the lawfulness of your submission. Staff may request clarification, reject duplicates, transfer matters to the appropriate intake point, close resolved or unsupported matters and refer necessary details to a competent agency or aid partner. A case reference confirms receipt or recording, not that the allegation is proven. Correct material errors promptly and keep copies of your important documents.
6. Acceptable use
Do not threaten, harass, defame, discriminate unlawfully, incite violence, publish private information without authority, exploit children, infringe intellectual property, upload malware or submit fraudulent requests. Do not probe for another person’s case, scrape resident information, bypass permissions, abuse automated requests, manipulate polls or interfere with service availability. Criticism, disagreement and lawful political discussion are not by themselves abuse. Security testing requires separate authorisation; reporting a suspected vulnerability does not authorise accessing more records. Preserve evidence safely and contact the responsible operator.
7. User content and moderation
You retain rights you hold in your submissions. You grant the responsible organisation the limited permissions needed to store, format, review, reproduce and share them for the requested service or chosen public publication, including necessary technical processing by its providers. This is not a transfer of ownership or a blanket licence for unrelated advertising or AI training. Public posts may be reviewed, restricted or removed for unlawful content, privacy exposure, credible threats, spam or material rule violations. Ask for reasons and review through the contact channel. Evidence may be preserved where lawfully necessary; external copies may remain after removal.
8. Political communications and fundraising
Harapan Kita is intended for DAP’s own authorised use. Requesting assistance, answering a community poll or contacting a service centre does not enrol you as a party member or authorise unrelated political messaging, fundraising or voter profiling. Such optional uses require a separate, specific lawful process and consent where required; refusal or withdrawal must be recorded and respected. Necessary case referrals and technical processing are permitted within the Privacy Policy. The current source code does not establish a platform payment or donation-checkout service. Do not assume an external payment request is authorised merely because it mentions the platform.
9. AI and third-party services
AI-generated answers, summaries, translations and images may contain errors, omissions or outdated information. Verify material facts and seek a qualified professional where appropriate. Ask for a human agent in consultations; handover and later new conversations follow the service’s displayed workflow. Do not rely on AI for urgent safety decisions or binding eligibility advice. WhatsApp, maps, social sharing and external sites have separate terms and availability. Messaging through a linked WhatsApp account is not a guarantee of an official Business API relationship, continuous delivery or platform control over the recipient’s copies.
10. Privacy, records and confidentiality
The Privacy Policy, PDPA & Your Rights and Cookies & Analytics documents explain data practices and choices. A service agreement does not replace required personal-data consent. Staff and technical providers must protect resident information and use it only within authorised purposes. Current instructions retain operational records and backups indefinitely; this remains a retention-compliance issue requiring review, not an unconditional right to retain. Account closure, disabled modules and disconnection of a messaging account do not automatically erase records. Requests for access, correction, withdrawal or deletion must be assessed under applicable law.
11. Availability and suspension
Maintenance, feature settings, outages, security incidents and third-party limitations may interrupt the service. Protect your own copies of important documents and use the published contact channel for time-sensitive matters. Access may be restricted where reasonably necessary for security, suspected unlawful use, loss of staff authority or material violation of these terms, with an explanation and opportunity for review where practicable and lawful. Restrictions must be proportionate and must not remove statutory privacy rights. Retention after suspension must follow a lawful schedule rather than a presumption that suspension authorises permanent storage.
12. Platform material and intellectual property
Platform software, layout, logos and published materials remain subject to their owners’ rights and any applicable open-source licences. You may use the platform for its intended services and share materials through the offered public sharing functions. Do not falsely claim endorsement, remove attribution or privacy/security markings, or republish confidential records. Third-party names and marks identify their respective services; their appearance does not imply they endorse this platform. Report an alleged rights violation with the relevant URL, your rights or authority and a clear description, without unnecessarily exposing personal information.
13. Responsibility and statutory protections
Services and published information are supplied with reasonable care appropriate to their purpose, but cannot guarantee uninterrupted access, complete accuracy or a successful case outcome. Each party remains responsible for its own unlawful conduct and breach of applicable duties. Any limitation operates only to the extent Malaysian law permits and does not exclude liability that cannot lawfully be excluded, fraud, or mandatory personal-data and other statutory rights. These draft terms do not impose an arbitrary monetary liability cap, a blanket user indemnity or a waiver of the right to complain to a regulator.
14. Complaints, governing law and changes
Contact the responsible service centre or the privacy contact with the issue, relevant date and reference so it can be reviewed. Where practicable, parties should first try to resolve service disputes through that channel. Malaysian law governs the effective agreement, subject to mandatory protections and the jurisdiction of competent courts; no compulsory private arbitration or barrier to a regulator complaint is created. If a provision is invalid, the remainder applies only so far as lawful and workable. Material changes require a new version, notice and effective date and any acceptance or fresh consent legally required; changes must not retroactively authorise unrelated data use.
